WAIVER AND RELEASE OF LIABILITY
By participating in the Your First Pull-Up Training provided by Angela Gargano and Angela Gargano Fitness Inc. ("the Company"), I acknowledge that I will receive 10 days of access to the training, including 10 days of coaching in a private community. I declare that I am free and clear to engage in any physical activity and that I do not have any underlying health conditions prohibiting or limiting me from participating in any physical activity, exercise/training sessions, and/or diet programs. I declare that I have not been advised to perform any physical activity, exercise/training sessions, and/or diet programs under medical supervision only. I further declare that I have clearance from my physician/primary care provider to participate and engage in any physical activity, exercise/training sessions, and/or diet programs.
I understand that there are inherent risks involved in physical activity, exercise/training sessions, and/or diet programs, but this is my informed consent to continue. I agree to release and discharge Angela Gargano and Angela Gargano Fitness Inc. (including, without limitation, its employees, staff, agents, and contractors) from any and all claims or causes of action (known or unknown) arising out of negligence.
I acknowledge that I have carefully read this Waiver and Release of Liability and fully understand that it is a release of liability. I am waiving any right that I may have to bring a legal action to assert a claim against Angela Gargano and Angela Gargano Fitness Inc. (including, without limitation, its employees, staff, agents, and contractors) from any negligence, injury, and/or losses arising from any such training sessions/exercise and/or diet program(s) (including, without limitation, any injuries and/or losses as a result of any diet, supplementation, or training advice I may receive).
FITNESS PRODUCT PAYMENT AGREEMENT
This Fitness Product Payment Agreement (the “Agreement”) is entered into between Angela Gargano Fitness Inc., a company registered under the laws of Austin, Texas (hereinafter referred to as the “Company”), and the customer (hereinafter referred to as the “Customer”) purchasing the Your First Pull-Up Training (hereinafter referred to as the “Product”). This Agreement outlines the terms and conditions for the purchase of this training.
Fitness Product Description The Company agrees to provide the Customer with access to Your First Pull-Up Training for a duration of 10 days, including 10 days of coaching in a private community. This is a ONE-TIME PAYMENT program with no recurring fees.
Payment 2.1 Payment in Full: The Customer shall pay the total amount for the Your First Pull-Up Training upfront in one single payment. After the total amount is paid, they will have access to the Product for 10 days.
Payment Obligation 3.1 The total amount must be received by the Company on the date of purchase. Failure to make the full payment by this date shall result in the immediate revocation of access without any refunds.
No Refunds The Customer acknowledges and agrees that the Company does not offer refunds under any circumstances. This includes, but is not limited to, non-compliance with the payment terms, dissatisfaction with the Product purchased, or non-completion of the program due to a busy schedule or life situations.
Termination of Agreement In the event of revocation due to non-payment, the Customer’s access to the Product will be terminated immediately, and the Customer will not be entitled to any compensation or refund of any kind.
Entire Agreement This Agreement constitutes the entire understanding between the Company and the Customer with respect to the Product and supersedes all prior agreements, understandings, and representations. No modification or amendment to this Agreement shall be binding unless made in writing and signed by both parties.
PERFORMANCE AGREEMENT
ATTITUDE: I will under NO circumstances tolerate a negative attitude. This does not mean you are not allowed to be human (we all have bad days), but it does mean you are responsible for your own checks and balances. Keep things in a positive perspective, remember your “why,” and focus on your purpose. You can come to me with any issue as long as your intention is to work towards resolving it.
HONESTY: I will never judge you as a client for any slip-ups, mistakes, or poor decisions. However, I need you to be as transparent as possible so I can track all details. There is no sense in me spending time creating a plan for you if you are not going to follow it, or in me trying to figure out what’s not working if the truth is you just haven’t been consistent.
EFFORT: You have to show up for yourself 110% every day, no matter what. The harder you work for me, the harder I work for you. I am not a “hand-holder,” and I cannot be there for you every single time you have a setback. This is where you will learn to become self-accountable and self-sufficient. YOU are the HERO, and this is your journey. I am just the guide.
TRUST: You are going to be pushing through some major personal development and growth during this process. Let go of the resistance to figure out how this is all going to unfold and trust YOURSELF, MY EXPERIENCE, and the PROCESS.
YOUR UNDERSTANDING: By participating in Your First Pull-Up Training, I agree to give 110% commitment to the program, and because I am solely responsible for my progress, I understand that NO refunds will be given regardless of whether or not the program is completed in its entirety.
COMMUNICATION POLICY If you are enrolled in Your First Pull-Up Training, you agree to follow the rules set forth for interpersonal conduct with the Company (including, without limitation, its employees, staff, agents, and contractors). In any communications via direct messages, online posts, comments, or emails, your language must be considerate, courteous, and kind.
The Company’s platform and programs are meant to provide support, motivation, and answers to questions. You agree not to harass, bully, or otherwise make any of the Company’s employees, agents, contractors, or other members uncomfortable. If you violate any of these terms, the Company may refuse to respond to messages, delete your messages, or discontinue your use of the platform and program at any time. NO refunds will be given regardless of whether the program is completed in its entirety or not.
PHOTO RELEASE CONSENT I hereby grant Angela Gargano and/or Angela Gargano Fitness Inc. (collectively, “AGF”) the right to reproduce, use, exhibit, display, broadcast, distribute, and create derivative works of photographs and/or videos for use in connection with the activities and mission of AGF.
This grant includes, without limitation, the right to publish such images on AGF websites, in reports, publications, and PR/promotional materials. If you do not want your photos/videos used, please email [email protected] after purchase, and we will make a note on your account. Any before/after transformation photos will only be used with your permission.
